From The Hindu, April 4, 1925: Damages to Indian roads — A suggested remedy

The special damage caused to Indian roads by certain classes of traffic is very serious one both for the tax-payers and for the ordinary road user. A remedy by which those who cause the damage may be called upon to bear the cost is found in the English law.

In Section 23 of an English Act of Parliament passed in 1878, and called the Highways and Locomotive (Amendment) Act, provision is made for the recovery of extra-ordinary expenses which have been incurred in the repair of a highway by reason of the damage caused by excessive weight or extraordinary traffic, the person by whose order such traffic has been put upon the road being made liable to pay the extra-ordinary expenses incurred in the repair of the road.
